David B. Rosemberg

David has been a commercial trial lawyer for more than two decades. He founded Rosemberg Law in 2017 to represent sophisticated clients on his own terms — selectively, personally, and at trial when the matter requires it.

David began his career in 2002 at a national defense firm in Miami. From 2005 to 2008, he practiced at a Miami white-collar defense and litigation boutique. From 2008 to 2017, he was at one of Florida's largest firms, where he was elected its youngest litigation partner in 2012. He founded Rosemberg Law in 2017.

His practice spans five principal areas: complex business litigation, including shareholder, partnership, and intra-family disputes; intellectual property litigation, with a particular focus on trademark enforcement and copyright recovery; international and cross-border matters, including U.S. litigation and arbitration on behalf of Latin American family offices and individuals; selected high-stakes personal injury matters; and ongoing reputation and risk counsel for prominent South Florida physicians and other professionals.

Fluent in Spanish, David serves as outside counsel to ultra-high-net-worth Latin American family offices and individuals with personal and business interests in the United States. From 2009 to 2014, he represented Latin American family investors in claims arising from the Madoff Ponzi scheme — appearing in international AAA and FINRA arbitrations against several European-headquartered banks.

His clients include public and private companies across communications, construction, entertainment, fashion, financial services, healthcare, insurance, manufacturing, real estate, and technology. He also represents real-estate developers, investors, owners, technology founders, family-owned businesses, and family offices.

Business Litigation

Counsel for a 50% member and his holding entity in a multi-front commercial dispute concerning a nationally recognized consumer home-furnishings brand. Representation spans defense against fiduciary duty, tortious interference, and injunctive claims, and prosecution of related claims for judicial dissolution under the Florida Revised Limited Liability Company Act, breach of fiduciary duty, civil conspiracy, aiding and abetting against the company's outside accountants, and tortious interference with a third-party business relationship.

Defense of a Florida real-estate holding corporation and its sole director against a judicial-dissolution action filed by a fifty-percent foreign-investor shareholder. The matter involves claims for statutory dissolution under the Florida Business Corporation Act based on alleged director deadlock, waste of corporate assets, and illegal or fraudulent conduct, together with a request for appointment of a receiver to manage and liquidate the company's sole remaining asset.

Representation of a Florida investor in federal court against a New York–based real-estate crowdfunding firm in a failed development matter, including the successful prosecution of dispositive motions on breach-of-contract and securities-related claims.

Defense of an individual founder and a related business entity in Miami-Dade Circuit Court against claims by a putative co-founder seeking ownership of the business, its intellectual property, and its goodwill. Plaintiff asserted breach of an alleged oral partnership agreement, fraud in the alternative, and declaratory relief.

Since 2017, outside national trial counsel to a global luxury eyewear company on trademark enforcement matters throughout the United States, handling more than 150 matters involving the company's owned brands, including pre-suit resolutions and filed actions asserting direct and contributory trademark infringement.

Representation of a Grammy-winning American recording artist, songwriter, and bandleader in a copyright recovery action in the U.S. District Court for the Southern District of New York to reclaim ownership of master recordings and copyrights in the artist's catalog.
International & Cross-Border

Representation of Latin American family investors in international AAA and FINRA arbitrations against European-headquartered banks in claims arising from the Madoff Ponzi scheme. (2009–2014)

Representation of claimants in an American Arbitration Association proceeding against a U.S. medical-equipment supplier involving allegations of commercial bribery and kickbacks in the cross-border sale of refurbished radiation oncology equipment. Claims asserted under the federal Racketeer Influenced and Corrupt Organizations Act, state commercial bribery law, breach of contract, and declaratory relief.

Plaintiff-side prosecution of an eight-count action in the Miami-Dade Complex Business Litigation Division on behalf of a Latin American investor and family trust against a Florida-based real-estate sponsor, an affiliated development company, and an unregistered intermediary. The matter involves claims under the Florida Securities and Investor Protection Act for the sale of unregistered securities through unregistered dealers and for a scheme to defraud, together with common-law claims for fraud, aiding and abetting fraud, breach of fiduciary duty, and an accounting.

Representation of an individual in a Florida personal-injury action against a food-delivery platform and its delivery driver arising from a motor-vehicle collision, including claims involving the platform's liability for the conduct of its delivery contractors.
