Intellectual Property.
Brand owners protect what they have built. Creators recover what is theirs. The work is enforcement, defense, and the patient prosecution of rights through federal court.
Intellectual property is the firm's second-largest practice line and one of its most substantive. The work centers on trademark enforcement and anti-counterfeiting on the brand-owner side, and on copyright infringement and recovery on the creator side.
Since 2017, the firm has served as outside national trial counsel to a global luxury eyewear company on trademark enforcement matters throughout the United States, handling more than 150 matters involving the company's owned brands, including pre-suit resolutions and filed actions asserting direct and contributory trademark infringement.
On the creator side, the firm represents recording artists, authors, and rights holders in copyright recovery actions to reclaim ownership of master recordings and catalog works. Termination of transfer under the Copyright Act, synchronization licensing disputes, and recovery of misappropriated works are part of the regular practice.
Trademark infringement & brand protection.
Infringement litigation, false designation of origin, and dilution matters on behalf of brand owners — and the defense of accused parties when the claim has been overreached.
Copyright infringement & enforcement.
Copyright disputes across creative, commercial, and digital works — including unauthorized reproduction, derivative-work claims, and DMCA-adjacent matters.
Anti-counterfeiting & online marketplace enforcement.
Coordinated takedowns, seizure actions, and litigation against counterfeit and gray-market sellers operating on U.S. and offshore platforms.
Copyright termination & publicity rights.
Statutory termination matters, right-of-publicity claims, and the disputes that follow when commercial use outlives a creator's original agreement.
Every intellectual property engagement is handled directly by David B. Rosemberg, the firm's founder and trial counsel. When a matter requires additional capacity — the firm brings in trusted co-counsel and other support under direct partner supervision.
David has been a commercial trial lawyer for more than two decades. He founded Rosemberg Law in 2017 after nine years at one of Florida's largest firms, where he was elected its youngest litigation partner in 2012.
